Statewide, there was not a single day without a traffic fatality in 2020, and from 2019 to 2020 Texas experienced a nearly 8% increase in the number of traffic fatalities. How You Can Help
OUR LAWYERS BUILD YOUR CASE
Our car accident lawyers will work to build you a winning case so you can receive financial justice and rebuild your life. While our lawyers will handle as much of your car accident case as possible, there are some actions you can take to help yourself:
Protect Evidence
The best tool our attorneys have to build your case is hard evidence. Many clients keep all photos and other evidence on their phones or computers. These devices are prone to unexpected breaks and can be lost, resulting in the evidence supporting your case disappearing. To make sure you always have it, you should back your evidence up on multiple devices, email it to yourself, and print hard copies. Finally, sending our car accident lawyers the evidence will provide another place to keep it safe.
Don't Admit Fault
Auto accidents are naturally scary and jarring. It can feel like the right thing to do is to apologize to the other driver, even when you did nothing wrong. Additionally, tempers flare following auto accidents, and the other driver may angrily pressure you into admitting fault. It is very important that you do not admit fault for the accident in any way. Apologizing for an accident can be considered admitting responsibility. Any confession by you can be used as evidence of your guilt and will only harm your car accident case.
Seek Medical Care
Injuries sustained in traffic accidents are often not immediately apparent. Even if you think it is physically unnecessary, it is wise to seek medical attention after a crash. First of all, this can help ensure your health by allowing a physician to identify and treat problems you may not even be aware of. It can also be very crucial evidence for your case. Medical records and medical bills can help prove your injuries, and a lack of doctor’s visits may be used by the defense as evidence that you were not really injured.
Important Texas Laws to Know
It is important to understand the laws surrounding your car accident. Our lawyers are more than happy to answer any questions you may have.
Statute of Limitations
Statute of limitations laws set strict deadlines for when a lawsuit must be filed by. These vary from state to state. In Texas, a personal injury lawsuit seeks compensation for damage to yourself or your property. The statute of limitations on these types of suits is two years from the date of the accident. Wrongful death lawsuits seek financial compensation for the tragic passing of a loved one that was caused by another person’s negligence. The wrongful death statute of limitations in Texas is two years from the date of death. In a small set of circumstances, the deadline may be extended. If you are worried that you have lost the ability to file a lawsuit due to the statute of limitations, it is wise to allow our lawyers to review the facts and determine if we may be able to pursue the case on your behalf.
Modified Comparative Negligence
Some folks believe that unless their driving was perfect before an auto accident, they are not entitled to any financial compensation. This is a common misconception. Texas law operates under modified comparative negligence. This means that even if you made a mistake on the road, you may still be deserving of financial compensation for your injuries, medical bills, and more. The key point to be proven is that another driver is at fault for your injuries, and even if you did commit an error, the other driver carries more responsibility for the accident. Traffic laws and the legal system can be hard to parse without legal education and decades of practice. Through handling thousands of cases, our attorneys understand how to prove when a client may be partially at fault but still deserving of compensation.
Tips for Talking to Insurance
The best tip our personal injury attorneys can give for talking to insurance companies following an accident is to not speak to them at all. What you say can and will be used against you. Once you retain our personal injury lawyers we will handle contact with insurance companies.
However, if you currently do not have an attorney and happen to find yourself speaking to an insurance company regarding your accident, these are some suggestions:
- Identify who you are talking to
- Remain polite and non-aggressive
- Refuse any pressure to settle your claim
- Tell them you would like no further contact
- Do not speak about the car accident or your injuries
- Take notes of what they say to you and what you say
- Don't give personal information besides name, address, & phone number
